Terms of Service

1. The Service

Gamma Flow is a real-time data visualization tool that displays gamma exposure (GEX) maps and related options-market metrics for SPX, SPY, and QQQ. The Service is delivered as a web application and is intended for educational and informational purposes only.

We do not provide investment advice, recommendations, or trading signals. The Service is a presentation of derivative options-market data sourced from third-party providers. Your interpretation and use of this data is solely your responsibility.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are 18 years of age or older.
• You have the legal capacity to enter into binding agreements in your jurisdiction.
• Your use of the Service is not prohibited by applicable law.

3. Account and subscription

The Service is sold by subscription through Whop (whop.com). All payments, refunds, plan changes, and cancellations are processed by Whop under their terms.

We offer two subscription tiers:

• Starter: $49.99 USD per month. SPX heatmap and related features.
• Pro: $89.99 USD per month. SPX, SPY, and QQQ heatmaps and related features.

Subscriptions auto-renew monthly unless cancelled. You may cancel at any time through your Whop account; cancellation takes effect at the end of the current billing period.

We reserve the right to modify pricing, plan contents, or available features at any time. Material changes will be communicated by reasonable means (e.g., notice on the Service or email).

4. Authentication

The Service uses Whop’s OAuth integration for authentication. To access subscriber features, you must have an active Whop account and an active subscription to one of our plans.

You are responsible for maintaining the security of your Whop credentials. We are not liable for unauthorized access to your account resulting from compromised Whop credentials.

5. Acceptable use

You agree to use the Service only for personal, non-commercial purposes consistent with these Terms. You will not:

• Scrape, mirror, or programmatically extract data from the Service.
• Resell, redistribute, or commercially exploit data obtained from the Service.
• Reverse engineer, decompile, or attempt to derive the source code of the Service.
• Use the Service to develop competing products.
• Share your account credentials with any other person.
• Use automated tools to access the Service without our written consent.
• Interfere with or disrupt the Service or its supporting infrastructure.
• Use the Service in violation of any applicable law or regulation.

6. Intellectual property

The Service, including its software, design, branding, methodology, and accompanying content, is the exclusive property of Skopos and its licensors. Nothing in these Terms grants you any right or interest in this intellectual property other than the limited right to use the Service as expressly permitted.

The “Skopos” name, the “Gamma Flow” name, and the related logos are trademarks of Skopos.

The underlying options-market data displayed in the Service is licensed from third-party providers; this data is presented to subscribers for personal informational use only and may not be redistributed.

7. Not financial advice

The data, visualizations, and copy generated by the Service (including any “today’s bias” text or level labels) reflect algorithmic interpretations of publicly available market data. These are not predictions, forecasts, or recommendations.

Trading options involves substantial risk. You may lose some or all of your invested capital. You alone are responsible for your trading decisions. If you are unsure whether options trading is suitable for you, consult a licensed financial advisor in your jurisdiction.

8. Data accuracy and service availability

We make reasonable efforts to display accurate, timely data. However:

• Data is sourced from third-party providers and may contain errors, gaps, or delays.
• We do not guarantee continuous, uninterrupted availability of the Service.
• Scheduled maintenance, third-party outages, or unexpected failures may cause downtime.
• Historical or stored data may be lost or corrupted.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied.

9. Disclaimer of warranties

To the maximum extent permitted by law, Skopos disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, accurate, complete, or uninterrupted.

10. Limitation of liability

To the maximum extent permitted by law, Skopos and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to lost profits, trading losses, loss of data, or business interruption, arising from or related to your use of the Service.

Our total cumulative liability to you for any claim related to the Service is limited to the total amount you have paid to Skopos (via Whop) for the Service in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow limitation of certain liabilities; those limitations do not apply to you to the extent prohibited by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Skopos and its affiliates from any claim, damages, or expense (including reasonable attorneys’ fees) arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your trading decisions or financial losses.

12. Termination

We may suspend or terminate your access to the Service immediately, without notice, if you violate these Terms. Upon termination, your right to use the Service ends; provisions that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification) will survive.

You may terminate your use of the Service at any time by cancelling your subscription through Whop.

13. Modifications to the Service or Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms; the “Last updated” date at the top of this page reflects the most recent revision. Material changes will be communicated via reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
